These Terms of Service ("Terms") govern your access to and use of CubHub, a childcare management platform operated by CubHub, LLC. ("CubHub," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you are accepting on behalf of a childcare center, you represent that you have the authority to bind that organization ("Center").
1. The Service
CubHub provides a subscription-based web and mobile application for childcare centers and the families they serve. Features include enrollment records, attendance, classroom management, messaging, billing, reporting, and related tools. We may add, modify, or remove features at any time; where a change materially reduces functionality, we will notify paying customers in advance.
2. Accounts and eligibility
You must be at least 18 years old to create a CubHub account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at security@cubhub.ai if you suspect unauthorized access.
3. Subscriptions and billing
Paid plans are billed monthly or annually in advance, in U.S. dollars, through our payment processor, Stripe. Fees are non-refundable except where required by law. You may cancel at any time from the billing settings in your Center; cancellation takes effect at the end of the current billing period. Unpaid invoices more than 14 days past due may result in service suspension.
Free trials, where offered, automatically convert to a paid subscription at the end of the trial unless canceled. We will remind you by email before conversion.
4. Acceptable use
You agree not to:
- Use the Service to store or transmit malicious code or infringing content.
- Attempt to gain unauthorized access to any account, system, or data.
- Reverse engineer, decompile, or scrape the Service, except as permitted by law.
- Upload content that violates the privacy or rights of any third party.
- Use the Service for any purpose unrelated to licensed childcare operations, or in violation of applicable laws, including COPPA and state childcare regulations.
We may suspend or terminate accounts that violate these rules.
5. Your content
You retain all rights to the information and media you upload to CubHub ("Your Content"). You grant CubHub a limited, worldwide, non-exclusive license to host, copy, display, and transmit Your Content solely to provide and improve the Service for you. We do not use Your Content to train third-party artificial intelligence models.
You are responsible for ensuring you have the necessary rights and consents to upload any content, particularly photos or information about children.
6. Data ownership and export
Your Center owns its data. You may export Center data at any time from the Reports and Billing sections, or by writing to support@cubhub.ai. On cancellation, we retain your data in a recoverable state for 30 days, then permanently delete it, except where retention is required by law.
7. Service availability
We work hard to keep the Service available, but we do not guarantee uninterrupted access. The Service is provided "as is" and "as available." We may perform scheduled maintenance, and we will provide advance notice for anything expected to cause material downtime.
8. Disclaimers
CubHub is a software tool and does not provide licensed childcare, medical, legal, or regulatory advice. Centers remain solely responsible for the care of children, compliance with licensing requirements, and the accuracy of records. To the maximum extent permitted by law, CubHub disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, CubHub's total liability arising out of or relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. In no event will CubHub be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits or lost data.
10. Indemnification
You agree to indemnify and hold harmless CubHub, its officers, employees, and agents from any claims, losses, or damages arising from (a) your use of the Service in violation of these Terms, (b) Your Content, or (c) your violation of any third-party right, including any privacy or intellectual property right.
11. Termination
You may terminate your account at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay amounts due, or use the Service in a way that creates legal or security risk. Sections intended to survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will continue to apply.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.
13. Text messaging (SMS) terms of service
By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from CubHub, LLC. This includes SMS messages for account notifications, attendance alerts, billing reminders, appointment confirmations, onboarding updates, customer care, and marketing. Message frequency varies. Message and data rates may apply.
Opt-in method. You may opt in to receive SMS messages from CubHub, LLC in the following ways:
- By submitting the contact form on our website and checking the SMS consent box.
- Verbally, during a conversation or demo call with our team.

Opt-out. To opt out at any time, text STOP. You may reply STOP to any message you receive from us, or update your notification preferences in your account settings. After opting out, you may receive one final confirmation message.

Supported carriers. Major U.S. carriers are supported, including AT&T, Verizon, T-Mobile, and Sprint. Service may not be available on all carriers. Carriers are not liable for delayed or undelivered messages.
Your consent to receive text messages is not a condition of purchasing any goods or services from CubHub. We will not share your phone number or SMS opt-in information with third parties for their marketing purposes.

14. Changes to these terms
We may update these Terms from time to time. If changes are material, we will notify you by email or in-app message at least 30 days before they take effect. Your continued use of the Service after an update means you accept the revised Terms.
